Terms of Service for Daily Boost - Motivation

By downloading, installing, or using Daily Boost - Motivation (the "App"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you disagree, do not use the App. These Terms form a binding agreement between you ("User" or "you") and Eric Blazek ("we," "us," or "our").

## Acceptance
You must be 13+ to use the App. If under 18, you need parental consent.

## License
We grant a limited, non-exclusive, revocable license to use the App for personal, non-commercial purposes. You may not modify, reverse-engineer, or distribute the App.

## User Content and Responsibilities
- **Ownership and Responsibility**: You own your custom content (e.g., boosts, sections) but are solely responsible for it. Ensure it's original; no copyrighted/trademarked material without rights. We have no liability for your content. Custom content is not shareable via the App.
- **Limits**: Free users: 0 AI boosts/day, 50 boosts/day, 3 custom sections/entries. Premium: 75 AI/day, 250 boosts/day, unlimited sections (500 entries max/section). Exceeding may result in suspension. AI rate limits: 75/day (subject to xAI limits; we may adjust).
- **AI Content**: AI-generated boosts are provided "as-is." You are responsible for any use/misuse. User is responsible for AI content.
- **No Advice**: Content (boosts, AI) is for entertainment/inspiration only—not mental health, financial, medical, or professional advice. Consult experts for real guidance.
- **App Availability**: The App may be unavailable anytime (e.g., maintenance, downtime). No guarantees of uptime/performance. App can go down or be down at any point.
- **Feedback**: Suggesting improvements is voluntary and does not guarantee or imply any response.

## Subscriptions and Fees
Premium features require a subscription via Apple App Store (auto-renews if applicable). Fees are listed in the App Store and subject to change. Manage/cancel  in Apple settings. No refunds from us-subject to Apple's terms.

## Acceptable Use Policy (AUP)
You must comply with this AUP, all laws, and xAI's terms (incorporated herein; at least as protective). Prohibited:
- Harmful/illegal activities: Violence, hate, discrimination, child exploitation, terrorism, hacking, fraud, defamation, spam, phishing.
- IP violations: Infringing copyrights/trademarks; no scraping/reselling content. Custom Entries should be originals only.
- Service abuse: Competing models/services; bots; disrupting/reverse-engineering the App/API.
- High-risk uses: Automated decisions affecting safety/rights (e.g., legal/medical); misleading as non-AI.
- Bias/non-compliance: Avoid biased/discriminatory content; comply with export/sanctions laws.
- Other: No medical/violence/hate; no clichés/trademarks in AI prompts (per App rules).

Violations may lead to suspension/termination without notice.

## Disclaimers and Liability
THE APP IS "AS-IS" WITHOUT WARRANTIES. WE DISCLAIM LIABILITY FOR DAMAGES, INCLUDING INDIRECT/CONSEQUENTIAL. OUR LIABILITY IS LIMITED TO $100 OR FEES PAID (LAST 12 MONTHS). Users own and are responsible for content; no liability for Daily Boost; custom content is not shareable.

## Termination
We may terminate access anytime. Upon termination, cease use and delete the App.

## Governing Law
Governed by laws of the United States and the State of Illinois. Disputes resolved via arbitration in Chicago, Illinois.

## Changes
We may update Terms. Continued use = acceptance.
